Terms & Conditions

Welcome to Pikup Ride Hailing Limited (“Pikup”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the Pikup ride-hailing application, website, and related services (collectively, the “Platform”). By accessing or using our Platform, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Platform.

1. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use the Platform. By using the Platform, you represent and warrant that the information you provide is accurate and truthful.

2. Our Services

Pikup provides a digital platform that connects users seeking transportation services (“Riders”) with independent third-party drivers ("Drivers").
Pikup is not a transportation company, nor do we employ drivers. Drivers operate as independent contractors.

3. User Accounts

To use the Platform, you must create an account and provide accurate information.

You agree to:

Maintain the confidentiality of your login credentials

Be responsible for all activities under your account

Notify us immediately of unauthorized access or use

Pikup may suspend or terminate any account that violates these Terms.

4. Payments and Fees

By requesting a ride, you agree to pay:

The fare displayed at booking or upon trip completion

Applicable taxes, tolls, surcharges, and service fees

Payments are processed through third-party payment providers. Pikup is not responsible for payment processing errors caused by those providers.

Failed or disputed payments may result in temporary account suspension.

5. Cancellations

Cancellation policies may vary based on location and trip type.

You may incur a cancellation fee if:

You cancel after the driver has accepted your request

You fail to show up at the pickup location

Pikup reserves the right to cancel any trip request for safety or operational reasons.

6. User Conduct

You agree not to:

Abuse, threaten, or harass Drivers or other users

Damage the vehicle or engage in unsafe behavior

Use the Platform for unlawful or fraudulent purposes

Interfere with the Platform’s operations or security

Pikup may ban or restrict users who violate this section.

7. Driver Conduct

Drivers are required to maintain high standards of professionalism, safety, and courtesy.
However, Pikup does not guarantee:

The quality of driving

The condition of the vehicle

The Driver’s behaviour

Riders are encouraged to report misconduct through the in-app reporting tools.

8. Safety

While we prioritize safety, Pikup cannot guarantee risk-free rides.

Users must:

Wear seatbelts at all times

Follow local safety regulations

Avoid distracting or endangering the driver

In emergencies, call local authorities immediately.

9. Intellectual Property

All trademarks, logos, designs, software, and content on the Platform are owned by Pikup or its licensors. You may not copy, modify, distribute, or reverse engineer any part of the Platform without written permission.

10. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.
Please review the Privacy Policy before using the Platform.

11. Disclaimers

To the fullest extent permitted by law:

The Platform is provided “as is” and “as available”

Pikup makes no warranties, expressed or implied

Pikup does not guarantee the availability, reliability, or quality of rides

Drivers are independent contractors. Pikup is not liable for their actions, negligence, or misconduct.

12. Limitation of Liability

Pikup shall not be liable for:

Indirect, incidental, special, or consequential damages

Loss of data, profits, or business opportunities

Personal injuries or property damage arising from the use of the Platform

Our total liability for any claim is limited to the amount you paid for the trip giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Pikup, its officers, employees, and affiliates from any claims, damages, liabilities, or expenses arising from:

Your use of the Platform

Your violation of these Terms

Your interactions with Drivers or other users

14. Termination

Pikup may suspend or terminate your access to the Platform at any time for violations of these Terms or for operational reasons.

You may delete your account at any time, though certain data may be retained as required by law.

15. Governing Law

These Terms are governed by the laws of Papua New Guinea.
Any disputes must be resolved in the courts of Papua New Guinea, unless otherwise required by law.

16. Changes to Terms

Pikup may update these Terms periodically. Updated Terms will be posted on the Platform with a revised “Last Updated” date. Continued use of the Platform constitutes acceptance of the revised Terms.
